Court returns murder case against Kapuyaukwu to Police

The Chief Magistrate Court grade one in Onitsha, Anambra State , S. N. Emejulu, has returned back to the Police the case file of murder charge against Afamefuna Obiekezie, popularly known as Kapuyaukwu and Tochukwu Emmanuel.
The presiding Chief Magistrate in returning the matter back to Police authority accused them of being confused over the case.
He ruled ” the Police authority is confused over this case. Therefore the case is returned to the Police and the defendant remanded in Police custody”.
He directed the Police to resolve its in house problems before returning the matter to the court, saying that whenever they are ready and had put their house in order the court shall hear it.
The confusion stemmed from a contradictory letter written to the Court by the Commissioner of Police, Legal Department, Force Headquarters, Abuja, Mr. Saturday Assayomo, that the Police was withdrawing the case. The letter was tendered by the defence counsel,E. C. Ezemenari
But the Prosecuting Police Officer, Akwali Edmund, countered the letter, saying that he was not aware of the so called letter.
He argued that if there was need for the withdrawal of the matter, he should be the person to file it.
He stated that his boss, the Officer in charge of Legal department, Anambra State Police Command had directed him to continue with the case.
The defence counsel wondered how a case against murder suspects could be withdrawn, assuring that another letter that will supercede that of CP, Legal Abuja would be tendered in the Court because it is not proper to set a murder suspect free.
In his ruling t Emejulu, directed the prosecution to tender his letter by Monday, July 20, 2020.
He warned that if there was no such letter by Monday, July he would be constrained to work with the letter before him.
However, on Monday July 20, the prosecutor wrote for an adjournment as he would not be in Court but N.D Nnodoma, held watching brief for him.
The duo of Obiekezie and Tochukwu were arrested and charged for attempted murder and murder in 2018 at Onitsha Magistrate Court.
The two suspects and others now at large stormed the office of their opponents in Onitsha with three buses in Delta State commercial bus colour, where they allegedly shot and killed one Akachukwu Ezebuilo, while Nnamdi Obumse was said to have sustained gunshot wound and matchete cuts.
They were arrested by the Police which granted them bail through the influence of a prominent Politician in the State but they jumped bail.
Obiekezie was however arrested for another offence and when the Inspector General of Police (IG) Special Tactical Squad (STS),where they had jumped bail heard of the arrest, they came, picked and arraigned
